The Staff, with <br />direction from the Board, revised the proposed findings of fact and recommendations of the Board to send to the <br />water court for Water Division No, 5. The Staff sent the revised findings of fact and recommendations to the Board <br />members and all of the parties on August 2, 2005. Two requests for clarification have been raised with the Staff <br />about the revised findings of fact and recommendations. <br /> <br />The first issue relates to how the Fourth of July holiday weekend flows will be in effect when the holiday falls on <br />the various days of the week. The Staff has added language to the newly revised fmdings of fact and <br />recommendations in paragraph 4 of the recommendations section, attached (not in redline), which clarifies this <br />Issue. <br /> <br />Second, there has been an issue raised about ramping rates, with regard to the language in the revised findings of <br />fact and recommendations. The CWCB Staff will be meeting with the Staff of the Denver Water Board, <br />Silverthorne, the Division of Wildlife, and Trout Unlimited on September 9, 2005 to discuss this matter to see if <br />further clarification and/or compromise can occur, The Staff will advise the Board of any resolution of this issue at <br />the Board meeting. <br /> <br />Staff Recommendation <br />The staff recommends that the Board: <br />a. Make any changes about ramping rates, as may be recommended by the Staff at the Board <br />meeting; and, <br />b, Authorize the Staff and the Attorney General's Office to send the attached findings and <br />recommendations to the Water Court for Water Division No, 5 before the September 16, <br />2005 deadline. <br /> <br />. <br /> <br />Flood Protection.
