The Board held a hearing regarding the Silverthorne RICD on July 20, 2005 in Frisco, Colorado. The Staff, with
direction from the Board, revised the proposed findings of fact and recommendations of the Board to send to the
water court for Water Division No, 5. The Staff sent the revised findings of fact and recommendations to the Board
members and all of the parties on August 2, 2005. Two requests for clarification have been raised with the Staff
about the revised findings of fact and recommendations.

The first issue relates to how the Fourth of July holiday weekend flows will be in effect when the holiday falls on
the various days of the week. The Staff has added language to the newly revised fmdings of fact and
recommendations in paragraph 4 of the recommendations section, attached (not in redline), which clarifies this
Issue.

Second, there has been an issue raised about ramping rates, with regard to the language in the revised findings of
fact and recommendations. The CWCB Staff will be meeting with the Staff of the Denver Water Board,
Silverthorne, the Division of Wildlife, and Trout Unlimited on September 9, 2005 to discuss this matter to see if
further clarification and/or compromise can occur, The Staff will advise the Board of any resolution of this issue at
the Board meeting.

Staff Recommendation
The staff recommends that the Board:
a. Make any changes about ramping rates, as may be recommended by the Staff at the Board
meeting; and,
b, Authorize the Staff and the Attorney General's Office to send the attached findings and
recommendations to the Water Court for Water Division No, 5 before the September 16,
2005 deadline.
