<br />Logan Irrigation District <br />May 16,17.2006 <br /> <br />Agenda Item 11a <br /> <br />1 <br /> <br />within the service area is primarily used to grow corn, alfalfa, sugar beets, pinto beans, and feed <br />crops, <br /> <br />Following adoption of a budget resolution in October, the LID certifies the required levy to the Logan <br />County Commissioners, with copies to the State Treasurer and Department of Local Affairs. State <br />revenue laws pertaining to the assessment, levying, and collection of property taxes (including <br />enforcement of penalties and forfeiture for delinquent taxes) are applicable to LID, LID may also <br />refuse delivery of water to lands until all past due or delinquent assessments have been paid in full. <br />(C,R.S 37-43-143.) Because this loan contract exceeds $75,000, the Irrigation District Law of 1905 <br />requires the LID to hold a special election of the legal electors in the district to authorize and ratify <br />the contract. C.R.S, 37-41-113(4), The election must follow the same procedures that the district <br />would follow to authorize the issuance of a bond. (See the election procedure in C.R.S. 37-41-117.) <br /> <br />Iliff Irrioation District (Cooperating Entity) - liD was also organized under the Irrigation District Law <br />of 1905 on March 6, 1911, There are 65 landowners and 10,874,3 District acres, The current levy <br />is $1.50/acre. The service area of the district extends from about midway between Sterling and IlIiff <br />east to about 3 miles east of Crook, <br /> <br />Moraan Prewitt Reservoir Companv (Cooperating Entity) - MPRC was organized as a Colorado <br />non-profit corporation on February 10, 1923. There are 58 shareholder holding 261 shares of <br />stock. The current assessment is $50 per share. MPRC serves various properties in Morgan and <br />Logan Counties, <br /> <br />e <br /> <br />As previously mentioned, a special agreement among the three parties is being drafted. This is <br />being drafted by LID attorney Mary Hammond and will specifically address loan responsibilities of <br />the parties, and will recognize CWCB as a 3m Party Beneficiary to the agreement. <br /> <br />Water Riohts <br /> <br />The Prewitt receives water under Priority 75A for storage of 32,300 acre feet of water at a rate of <br />695 ds with an appropriation date of May 25, 1910. The Prewitt Reservoir also has Priority 75R for <br />refill of up to 34,960 acre feet of water with an appropriation date of December 31,1929, <br /> <br />Proiect Description <br /> <br />The purpose of this project is to construct an emergency spillway to provide unrestricted overflow to <br />pass flows resulting from 75% of the Probable Maximum Precipitation (PMP) without overtopping <br />the dam, The hydrology study was completed by W,W, Wheeler and Associates, Inc. and has been <br />approved by the SEO, The investigation of the area adjacent to the reservoir revealed a natural <br />depression near the mouth of the inlet canal which would carry most of the flow from the PMP, but <br />was not low enough to bring the reservoir back down to its full storage level. The Prewitt Operating <br />Committee considered four alternatives in order to reach the current spillway design. The four <br />alternatives are: <br /> <br />1. The no-action alternative. <br />2. Lower the current natural depression, <br />3. Construct a pipe spillway near the west center area of the reservoir, <br />4. Construct a pipe spillway in the darn near the outlet. <br /> <br />e <br /> <br />Alternative 1, No-action alternative - This was considered unacceptable since it means the <br />Prewitt Reservoir storage would be further restricted by the SEO. <br /> <br />Page 3 of 6 <br />
