<br />, <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Contents of Written Comments <br /> <br />Written comments may include any written data, views or arguments concerning the <br />proposed amendments to the ISF Rules and may contain alternative rules and regulations, <br />legal arguments or briefs, and materials prepared by persons other than the submitter. <br /> <br />Oral Presentations <br /> <br />Oral Presentations will be available to the public and will be limited to no more than <br />5 minutes. (Time may be reduced depending upon the number of people requesting an <br />Oral Presentation). <br /> <br />Review of Administrative Record <br /> <br />The Administrative Record, including the proposed rule, public written comments, <br />all staff written comments and all other written materials to be considered by the CWCB <br />by this rulemaking, will be available for inspection at the CWCB office during normal <br />business hours (8:00 a.m. - 5:00 p.m.) August 31,1994 through September 12,1994. Copies <br />are available at the CWCB for 50 cents per page. <br /> <br />HEARING PROCEDURE <br /> <br />The CWCB will not apply the rules of evidence or civil procedure. No right to cross <br />examine shall be given to any person, except that CWCB members may ask questions of any <br />person appearing before them. Any questions that members of the public have of the staff <br />will be responded to at the end of all public comment. <br /> <br />The chair of the CWCB will have the authority to stop any Oral Presentation if the <br />person speaking has exceeded their allotted time. No exhibits, maps, demonstrative exhibits <br />or physical evidence may be presented in the Oral Presentation unless it is attached to the <br />participant's written comment. Once the written comment is submitted for consideration <br />by the CWCB, the material becomes part of the Administrative Record and the property <br />of CWCB and will not be returned to the person offering the material. <br /> <br />SPECIFIC STATUTORY AUTHORITY <br /> <br />The statutory authority for the ISF Rules is found at ~ 37-60-108 C.R.S. (1990), ~ <br />37~92-102 C.R.S. (1994 Cum. Supp.) and ~ 37-92-102(3)(c.5) C.R.S. (1990). Should the <br />CWCB adopt the amendments to the ISF Rules as proposed in this notice or alternative <br />amendments, it will also adopt an appropriate Statement of Basis and Purpose, and Specific <br />Statutory Authority. <br />
