<br />, <br />.~t;.. <br /> <br />3. <br /> <br />A stated purpose of the salinity control program is to allow full development by the Upper <br />Basin of its water supplies, activities such as buy-out/retirement of existing water users would <br />appear to be incompatible with this key program objective, and would require careful <br />consideration by the states. <br /> <br />e <br /> <br />While Reclamation currently ooderstands these limitations there is always a risk that the <br />proposed broader authority will be used to implement a land retirement/water marketing effort <br />through the salinity program. While this risk is real, staff believes there are at least four safeguards <br />that will remain after the 1994 amendments: <br /> <br />1. Reclamation must still consult with and receive recommendations from the Seven States <br />acting as the CRBSC Advisory Cooocil. <br /> <br />2. Reclamation must continue to comply with all procedural and substantive state water <br />laws. <br /> <br />3. The Act is specifically not intended to alter, amend, abrogate or modify the terms of <br />the Colorado River Compact. <br /> <br />4. The Act states that the Secretary of the Interior is to implement the salinity control <br />policy developed by the States as stated in the Proceedings of the Reconvened 7th <br />Session of the Conference in the Matter of Pollution of the Interstate Waters of the e <br />Colorado River, which contains express language regarding allowing the Upper Basin <br />to develop its compact apportionment. <br /> <br />Appropriate report language will be provided to the House and Senate Committees to reflect <br />the Basin State's ooderstanding that Reclamation's new authority will be exercised consistent with <br />current program objectives and existing safeguards. The CRBSC Forum is in the process of <br />preparing suitable statements for the committee reports and the CWCB Director will be conferring <br />with members of the Colorado Congressional Delegation to make sure these concepts are reflected <br />in the legislative history. <br /> <br />An additional issue of potential concern is the probable "packaging" of S. 2319 with several <br />other pieces of water resource legislation, which is always a risk with federal legislation, and we will <br />need to closely monitor the process. <br /> <br />Recommendation: <br /> <br />Staff recommends that the Board continue to support S. 2319 and H.R. 4976 and work with <br />the Colorado Congressional delegation and the CRBSC Forum to monitor progress on the bills and <br />develop a clear record in committee reports expressing Colorado's views. The Salinity Control <br />Program must be implemented consistent with the Colorado River Compact and with Colorado's <br />intention and right to fully develop our compact apportionment. <br /> <br />e <br /> <br />94legisl.anl <br />
