Lile, P.E. <br />Director, Colorado Water Conservation Board <br />Suite 721 <br />1313 Sherman Street <br />Denver, CO 80203 <br /> <br />Re: Comments on Proposed Amendments to ISF Rules <br /> <br />Dear Chuck: <br /> <br />On behalf of the Southeastern Colorado Water Conservancy District ("Southeastern"), <br />we comment as follows regarding the proposed amendments to Sections 6 and 7 of the CWCB's <br />Instream Flow and Natural Lake Level Rules and Regulations ("ISF Rules"). <br /> <br />As you know, Southeastern strongly supported the recently-enacted Senate Bill 94-54, <br />particularly as a means of resolving some concerns of Southeastern and others regarding the <br />CWCB's treatment of conditional water right acquisitions in the ISF Rules adopted last year. <br />The proposed amendments to the ISF Rules are in accord with both the express language and <br />the spirit of SB 94-54, so Southeastern supports the proposed rule amendments as presented with <br />your letter of July 28, 1994. <br /> <br />Please let us know if the CWCB plans to consider any particular modifications or <br />additions to the July 28 proposed rule amendments. We would also like the opportunity to <br />review other parties' written comments prior to the hearing on September 13, so that we can <br />determine to what extent Southeastern may wish to participate in that hearing. <br /> <br /> <br />- <br /> <br />Stephen H.
