e

e

e

BEFORE THE COLORADO WATER CONSERVATION BOARD

COMMENTS OF THE CITY OF COLORADO SPRINGS

IN RE: PROPOSED AMENDMENTS TO SECTIONS 6 AND 7 OF THE INSTREAM
FLOW AND NATURAL LAKE LEVEL RULES AND REGULATIONS (ISF RULES)

The City of Colorado Springs Water Resources Department,
through its counsel, Anderson, Gianunzio, Dude, Pifher & Lebel,
P.C., by Mark T. Pifher, hereby submits its comments upon the
Proposed Amendments to Sections 6 and & 7 of the Instream Flow
and Natural Lake Level Rules and Regulations (ISF Rules).

The City supported the adoption of SB94-54. It appears
that the proposed amendments to the ISF Rules are merely intended
to conform the rules to the provisions of SB94-54 as codified at
C.R.S. S37-92-102(3). The City therefore supports these changes.
It is the understanding of the City that the current rulemaking
will not extend beyond the scope of the provisions of SB94-54.

The City would request that copies of all additional
written comments filed with the Board be provided to counsel for
the City prior to the September 13, 1994, rulemaking hearing.
This will enable the City to better prepare for the hearing, and
to determine if any supplemental oral comments will be necessary.

Respectfully submitted this ~day of August, 1994.

Counsel for City of Colorado Springs

ANDERSON, GIANUNZIO, DUDE,
PIFHER & LEBEL, P.C.

By: /Jl1~/ ;p;;-)

MarkvT.
