Evans <br />Acting Director, eweB <br /> <br />TO: <br /> <br />Colorado Water Conservation Board Members <br /> <br />FROM: <br /> <br />Randy Seaholm # <br />Chief, Interstate Streams Investigation Section <br /> <br />DATE: September 10, 1998 <br /> <br />SUBJECT: Agenda Item 20n, September 21-22, 1998 Board Meeting- <br />Colorado River Basin Issues <br />Lower Colorado Rule Allowing Offstream Storage - Status Report <br /> <br />As previously reported, Reclamation received 46 letters commenting on the proposed <br />Rule allowing, "Off stream Storage of Colorado River Water and Redemption of Storage <br />Credits in the Lower Division States," We have been informed that the final step is a <br />review by OMB and that Reclamation anticipates publishing the Final Rule in the Federal <br />Register soon (next 4 to 8 weeks is the latest estimate). However, before the Rule can be <br />implemented it must sit before Congress for 60 session days, During that 60 days <br />Congress can instruct Interior and Reclamation to: (1) pull back the rule for further <br />consideration, (2) modify the rule, (3) reject the rule, or (4) taken no action and allow the <br />rule to become effective at the end of the 60 day period, Since there are less than 60 <br />session days remaining in the current Congress, Reclamation has indicated that the Rule <br />can not become effective before March 1999, Reclamation as indicated that it intends to <br />mail a copy of the Final Rule to interested parties along with the Final Environmental <br />Assessment and Biological Opinion prepared for the Rule as soon as they are available, <br />We will continue to monitor this rule making process and keep you informed, <br />
