EMD LLC Alternative, This alternative requires EMD LLC to move its <br />municipal diversion point downstream to the Raw Water Booster Pump whenever instream flows <br />are inadequate to satisfY the CWCB's water rights and to replace all depletions with upstream <br />sources of water. As we have previously discussed, such a downstream change in EMD LLC's <br />senior irrigation water rights removes a large historic impact to the Eagle River, thus adding <br />water to approximately a 2-3 mile reach of the Eagle River, including during the critical month <br />of September. Moreover, any future impacts are limited to the 300 foot reach between the Raw <br />Water Booster Pump and the municipal outfall. This approach is the most desirable for EMD <br />LLC, <br /> <br />2. CWCB Staff Alternative, The proposal by the CWCB Staff was considered and <br />rejected by EMD LLC. This proposal would require EMD LLC to acquire sufficient storage to <br />replace 100% of its diversions (primarily during the nonirrigation season) whenever the CWCB' s <br />instream flow rights are not being met downstream of the Raw Water Booster Pump. As a <br />practical matter, since 95% of the winter diversions return to the Eagle River within 300 feet of <br />the municipal diversion point, this alternative requires EMD LLC to replace approximately 20 <br /> <br />. sb0530 <br />
