At times when the CWCB's instream flow water rights on the Lake Fork ofthe Gunnison River <br />are not satisfied, Applicant agrees to curtail its surface diversions or augment injurious surface <br />diversions in time, place and amount. <br />. At times when the CWCB's ins(n:arn flow water rights on the Lake Fork of the Gunnison River <br />are not satisfied, Applicant agrees augment the depletions associated with its wells in time, <br />place and amount. <br />. The Applicant also has agreed to install, maintain, and monitor such measuring devices as may <br />be required by the State and Division engineer to administer the tenns of the decree. <br /> <br />(3) Case No, S-02CW390; Gus and Anita Achey et aI, <br />The Board ratified this statement of opposition in March 2003. The Board's main objective in filing a <br />statement of opposition in this case was to assure that the Applicant replaced injurious depletions in time, <br />place, and amount. The Applicant has voluntarily dismissed the application. <br /> <br />(4) Case No. 5-03CW132; No.6 King Ditch <br />The Board ratified this statement of opposition in September 2003. The Board's main objective in filing a <br />statement of opposition in this case was to assure that the Applicant did not divert this senior water right at <br />the upstream alternate point of diversion at times when the CWCB' s intervening instream flow water right . <br />was not being satisfied. The Board's main objective in <br />filing a statement of opposition in this case was to assure that the Applicant did not divert this senior water <br />right at the upstream alternate points of diversion at times when the CWCB's intervening instream flow <br />water right was not being.
