The <br />change is being suggested in light of the reduction in the <br />Board's voting membership from 13 to 10 made by S.B. 439 (1981 <br />Session). Rep. P'3ulson has indicated that he would be willing to <br />introduce the bill. <br /> <br />Section 37-60-123, CRS 1973, as amended <br /> <br />This section states that construction fund projects "shall <br />be in substantial conformity with the state water plan as <br />authorized by section 37-60-118." However, neither section <br />37-60-118, nor the other reference to the Board's planning <br />responsibilities in section 37-60-115, call for a "state water <br />plan." Rather, these two sections refer to processes <br />("continuous study of the water resources of the State of <br />Colorado" in 37-60-115 and "a comprehensive water planning <br />program" in 37-60-118). Finally, section 37-60-122(1)(a) <br />requires the Board, when forwarding proposed projects to the <br />legislature, to comment "as to how the proposed project will <br />carry out the state water policy," not plan. <br /> <br />Given the provisions cited above and the clear relationship <br />between themr the reference in section 37-60-123 to a "state <br />water plan" is both unnecessary and misdirected. I therefore <br />recommend that the Board recommend the repeal of this section. <br />This could be readily handled in the annual projects <br />authorization bill. <br /> <br />(over) <br /> <br />140 <br />ail11 <br /> <br />John R.
