Applicant seeks to divert water from
the Roaring Fork River through the Bell Pump and Pipeline to maintain the water level of the Bell
Pond System to enhance the aesthetic value of the Applicant's property. Applicant
proposes to release water from the Bell Augmentation Pond (total capacity=0.05) when there is a
call on the Roaring Fork River upstream of its confluence with the Fryingpan River and release
contracted water from the Basalt Water Conservancy District system if the call is downstream of the
Roaring Fork River's confluence with the Fryingpan River.

CWCB Appropriations

The Board holds the following instream flow water rights that may be injured by thIS application:

CWCB Case
No.
5-76W2948
5-85CW646

Approp.
Date
l/] 4/76
11/08/85

Watershed

Amount
(cfs)
32
55/30

County

StreamlLake

Roaring Fork River
Roaring Fork River

Pitkin
Pitkin

Roaring Fork River
Roaring Fork River

Potential for Injury:

Applicant's proposed diversion and plan for augmentation may cause material injury to the Board's
instream flow water rights on the Roaring Fork River.

Other Obiectors
The City of Aspen also filed a Statement of Opposition to this application.

C:\Documents and Settings\Jjb\My Documents\Board Meetings\ConsentAgendal.j RoaringForkI LLC MarQ5.doc
