<br />e <br /> <br />e <br /> <br />e <br /> <br />129 <br /> <br />Consent Agenda Item 20 <br />Case No. 5-00CW305; Buttermilk Metropolitan District <br /> <br />Annlication Summarv <br /> <br />This is an application for an augmentation plan and change of diversion point near the City of <br />Aspen (see attached map). The Applicant seeks to change its water rights from the Stapleton <br />Brothers Ditch Enlargement and Water Right to a new well field that will be filed for in' a later <br />application. In addition, the Applicant seeks to augment depletions associated with the 'new <br />unidentified well field with water released from Ruedi Reservoir and from the Green Mountain <br />Reservoir. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instream flow water right for Maroon Creek and for the Roaring Fork River in <br />the amount of 14 cfs for Maroon Creek and amounts of 55 cfs (4/1-9/30) and 30 cfs (10/1-3131) <br />and 145 (4/1-9/30) and 75 cfs (10/1-3/31) for two different segments of the Roaring Fork River, <br />with appropriation dates of 1/14/76 and 11/8/85, respectively, which may be injured by this <br />application. <br /> <br />Potential for Iniurv <br /> <br />This application may not replace the depletions in time place and amount and thus may cause injury <br />to the Board's Maroon Creek and Roaring Fork River iustream flows. In addition, the Applicant <br />cannot be pennitted an expansion of its water rights pursuant to the requested change. <br /> <br />Other Obiectors <br /> <br />The other objectors in this case are: the Basalt Water Conservancy District; the Pitkin County <br />Board of County Commissioners; the City of Aspen; the Twin Lakes Reservoir and Canal Co.; and <br />the Town ofBasa1t. <br /> <br />IIDENVElUICWCBIWCTRANs\sECClCase Filesl2000\SQOCW305 _tnem,doc <br />
