<br />Governor Ralph L. Carr, Chairman of the Board, not being present, Vioe-
<br />Chairman Chris Wallrioh oalled the meeting to order at 10.,0 a.m., September
<br />16, 1942.
<br />
<br />The agenda of the meeting was distributed. The first item provided for
<br />oonsideration of the appointment of an attorney to perfonn legal servioes for
<br />the Board and the State of Colorado in interstate litigations. Direotor
<br />Stone called attention to the faot that the two oases, namely, Colcrado vs.
<br />Kansas-~ and Nebraska vs. Wyoming and Colorado, and the United States, Inter-
<br />vener, had reaohed a oritioal stage requiring a large Amount of legal work in
<br />order to properly prepare and present the position of the State of Colorado.
<br />He mentioned that Jean S. Breitenstein previously had been retained by the
<br />Board as special oounsel in the North Platte oase and that, after discussion
<br />of the matter with special counsel in the Kansas ease, who had been retained
<br />by Arkansas Valley interests, and after discussion and cansideration of the
<br />matter by the Attorney General's office, it has been considered that Jean
<br />Breitenstein should be retained by the Board, with the consent of the Attorney
<br />General, to perfonn legal services generally for the Board and particularly
<br />in behalf of the State of Colorado in all interstate water litigation. The
<br />outstanding qualifioations of Mr. Breitenstein for this type of work were
<br />discussed by Attorney ~etalclreland and Director Stone. The statute creat-
<br />ing the Colorado Water Conservation Board which provides that the Board _y
<br />appoint an attorney to perform such work, with the consent of the Attorney
<br />General, was oi ted. The many involved legal problems in conneeti on with
<br />work of the Board were oonsidered.
