.

e

e

4.

Is it necessary for an appropriator of a RISF right to schedule the recreational
activities and have beneficiaries of the right available to beneficially use the water
before the representative of the State Engineer's Office will anticipate or recognize a
call for the RISF right?

RESPONSE:

No--It is not required of other water users and should not be required for the owner of a
RD right. As explained in response to question number three, beneficial use, waste, and
other issues concerning the right should be resolved by the Water Court at the front end.
After passed through the filter of the Water Court, the danger of waster under a RD right
is no greater than for any other right. No legitimate legal or policy basis for disparate
treatment.

5
