<br />. <br /> <br />e <br /> <br />e <br /> <br />4. <br /> <br />Is it necessary for an appropriator of a RISF right to schedule the recreational <br />activities and have beneficiaries of the right available to beneficially use the water <br />before the representative of the State Engineer's Office will anticipate or recognize a <br />call for the RISF right? <br /> <br />RESPONSE: <br /> <br />No--It is not required of other water users and should not be required for the owner of a <br />RD right. As explained in response to question number three, beneficial use, waste, and <br />other issues concerning the right should be resolved by the Water Court at the front end. <br />After passed through the filter of the Water Court, the danger of waster under a RD right <br />is no greater than for any other right. No legitimate legal or policy basis for disparate <br />treatment. <br /> <br />5 <br />
