The UYWCD
supports an instream flow filing of 40 cfs, December I - July 31, and 20 cfs, August 1 _
November 30. In addition, the UYWCD is not opposed to entering into an agreement with the
CWCB to provide additional protection to flows below Stagecoach Reservoir that have been
used for hydropower production.

Staff has had several conversations with the UYWCD and is currently working with them to
develop an acceptable agreement that would address UYWCD's concerns and enable the Board
to protect instream flows in the amounts recommended by staff in January for the proposed
reaches. Staff has recommended that, pursuant to the Instream Flow Rules, UYWCD "Contest"
the proposed instream flow recommendations by filing a Notice to Contest. This would provide
both parties additional time to resolve their concerns and develop an acceptable agreement.

Yampa River Mar(lh Update.doc

Flood Protection.
