Kowalski <br /> <br />Dear Mr. Kowalski: <br /> <br />Reference is made to 9 37-92-102 C.R.S. (2001) ("SB 216"), the Recreational In-Channel <br />Diversion ("RICD") Rules as adopted by the Colorado Water Conservation Board ("CWCB") on <br />November 8, 2001 ("RlCD Rules"), and the CWCB's RlCD Technical Criteria and Policy . <br />Manual adopted on November 21,2003 ("RlCD Policy"). Without in any manner waiving the <br />rights of the City of Steamboat Springs to challenge the constitutionality and validity ofSB216, <br />the RICD Rules and the RlCD Policy, the City of Steamboat Springs submits the following <br />materials and information in support of its RICD application: <br /> <br />1. Application for Surface Water Rights of the City of Steamboat Springs filed with <br />the District Court in and for Water Division No, 6 on December 26, 2003, and assigned Case No. <br />03CW86. <br /> <br />2. Resolution No. 2003-74 adopted by the Steamboat Springs City Council on <br />December 16, 2003, authorizing the appropriation of water for the City's RICD and the filing of <br />the above-referenced application. <br /> <br />3. Report dated January 20, 2004, prepared by the water resource engineering firm of <br />W.W. Wheeler and Associates, Inc..which demonstrates that the adjudication and administration <br />of the City of Steamboat Springs' RICD will not impair the ability of Colorado to fully develop <br />and place to consumptive beneficial use the State's compact entitlement. <br /> <br />4. Report prepared by Gary Lacy, P,E., regarding the design and nature of uses of the <br />City of Steamboat Springs Boating Park. This report concludes that the flow rates requested are <br />the minimum amounts necessary to achieve the reasonable recreation experience for which the a <br />Boating Park was constructed. This report also addresses the lack of impact on the 100 year ., <br />flood plain. <br /> <br />fd8200 <br />
