RESOLUTION NO. 2003-74 <br /> <br />...~, <br /> <br />. .. <br />. .. <br />Resolution t.utl:oriz:ing the ApPlopriatioh of Vhtu fvI a <br />R pcre"ti"M"1 In-Chappel Diversion <br /> <br />Whereas, tlle Yampa River is a vital element of the Steamboat Springs communitY; and <br /> <br />Whereas, the presence ofthis river in tlle center.oftlle City of Steamboat Springs <br />("City"), and the recreational opportunities it provides, contributes substantially to the health and <br />.. welfare ofthe local economy and the area quality of life; and <br /> <br />Whereas, two in'channel diversion stmctures have been constructed on City property <br />within ihe streanl channel oftlle Yampa River; and <br /> <br />. Whereas, these structures dive11, capture and control water to concentrate and direct the <br />flow of tile Yampa River to create features that enhance therecreational use of the river for <br />kayaldng, rafting, tubing and other boating activities; and <br /> <br />Whereas, the City has assumed the responsibility and desires to obtain the necessary <br />water rights to ensure that the recreational in-channel diversion structures will operate as <br />designed and accomplish tlle intended benefits; and <br /> <br />. Whereas, the greater the flows of the Yampa River at the in-channel diversion structures, <br />the greater the beneficial use and tlle greater tlle resultant economic benefit; and <br /> <br />Whereas, the City has engaged in an extensive analysis of the minimum amount Of water <br />necessary to create a reasonable recreational experience for tlle intended use of tlle recreational <br />in-channel diversion structures; and . <br /> <br />:. Whereas, the minimum amount of water neces.sary to create areasonable recreation <br />experience in and on the water varies depending on the tirrie of year and the available flows; and <br /> <br />. . <br />Whereas,. the City has determined that the minimum flows necessary to achieve a <br />reasonable recreation experience for the intended recreation use of the Yampa River in-channel <br />. diversion structures during various periods of the year are as follows (hereinafter the "RICD <br />Flow Rates"): <br /> <br />Time April 15-30 May 1-15 May 16-31 June 1-15 June 16.30 July 1-15 Ju115- <br />Period .
