Applicant proposes to divert water at <br />a rate of2.0 cfs from the Snake River via the Rice Ditch with a 1999 appropriation date, Applicant <br />seeks to augment out-of-prioritY depletions associated with five ponds and wetlands with releases <br />from Dillon Reservoir using water obtained from the Vidler Twmel Water Company, <br /> <br />CWCB Aoorooriations <br /> <br />The Board holds an instream flow right on the Snake River for 12.0cfs during the swnmer months <br />and 6.0 cfs during the winter, with an appropriation date of March 14, 1986, which may be injured <br />by this application. <br /> <br />Potential for Iniury <br /> <br />Applicant's proposed plan for augmentation may not replace depletions to the Board's instream <br />flow water rights on the Snake River in the same amount, timing or location at which they occur.
