Box 25486 <br />Denver, CO 80225 <br /> <br />Mr. Greg Walcher, Executive Director <br />Colorado Department of Natural Resources <br />1313 Sherman St., Room 718 <br />Denver, CO 80203 <br /> <br />Subject: UDDer Colorado River Basin Endanl!ered Fish SDecies Recovery Prol!ram <br /> <br />~~~~ . <br /> <br />As we are all so keenly aware, over the last 18 months or so the U.S. fish & Wildlife Service <br />(Service), the State of Colorado Natural Resources agencies (State), environmental representatives, <br />and water users' representatives have been very focused on the 15-Mile Reach Programmatic <br />Biological Opinion (15MRPBO). <br /> <br />While the Colorado River Water Conservation District (River District) has been actively <br />participating in the development of and is directly concerned with the 15MRPBO, the River District <br />Board is also responsible for and concerned about with the areas of the River District not covered <br />by the 15MRPBO. Specifically, we are concerned that the issuance 'of another major <br />"programmatic" biological opinion, such as the Duchesne opinion, will result in limitations on water <br />users in other basins. . <br /> <br />The 15MRPBO is designed to provide some level of regulatory certainty for existing uses and up <br />to 120,000 a.f. of new uses on the Colorado River upstream of its confluence with the Gunnison <br />River. However, completion ofthe 15MRPBO will not protect existing or future water uses within <br />the Little Snake River, the Yampa River, the White River, the Gunnison River or the Dolores River <br />basins, all areas within the River District which are covered by the Upper Basin Recovery Program. <br /> <br />RECEIVED <br />MAY 1 0 1999 . <br /> <br />SUITE #204.201 CENTENNIAL STREET <br />P,O.
