<br />e <br /> <br />Agenda Item 16d <br />Case No. 5-97CW207; Gypsum Ranch, LLC <br /> <br />Application Summary <br /> <br />This is an application for groundwater rights, surface water rights, storage rights, and <br />approval of a plan for augmentation on the Eagle River near Gypsum in Eagle County <br />(see attached map). Applicant seeks to augment out-of-priority depletions associated <br />with gravel mining operations. To replace depletions to the Eagle River, Applicant <br />proposes changing the use of a senior irrigation right and storing water in the gravel pit <br />for later release during the non-irrigation season. Alternatively, Applicant proposes <br />release of augmentation water from Ruedi Reservoir. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instream flow right on the Eagle River for 130 cfs, summer, and SO <br />cfs, winter, with an appropriation date of March 17, 1980, which could be injured by this <br />application. <br /> <br />Potential for Iniurv <br /> <br />e <br /> <br />The Applicant's plan for augmentation may not replace depletions to the Eagle River in the <br />same amount, timing, or location at which they ocCur.
