<br />1 <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 16a <br />Case No. 1-97CW256; Florissant <br /> <br />Application Summary <br /> <br />This is an application for groundwater rights, approval of a plan for augmentation, and an <br />exchange of water on the Middle Fork of the South Platte River and Sacramento Creek <br />near Fairplay in Park County (see attached map). Applicant seeks to augment out-of- <br />priority depletions associated with operation of a well field near Florissant. To augment <br />depletions, the District has purchased shares of capital stock in the Mountain Mutual <br />Reservoir Company which owns the Guiraud 3T Ditch and Lower Sacramento Creek <br />Reservoir No. 1. During the irrigation season, Applicant proposes to replace depletions <br />with consumptive use credits associated with the Guiraud 3T Ditch water rights. During <br />the non-irrigation season, Applicant proposes to exchange water from the headgate of the <br />Guiraud 3T Ditch to the Lower Sacramento Creek Reservoir No. I under a priority date <br />of February 28, 1980. Applicant proposes a maximum exchange rate of 0.005 cfs. <br /> <br />CWCB Approoriations <br /> <br />The Board holds an instream flow right on this segment of the Middle Fork of the South <br />Platte River for 16 cfs, summer, and 8 cfs, winter, with an appropriation date of January <br />30, 1980, which could be injured by this application. <br /> <br />Potential for Iniury <br /> <br />The Applicant's plan for augmentation and exchange may not replace depletions to the <br />Middle Fork of the South Platte River in the same amount, timing, or locations at which <br />they occur. <br /> <br />Other Obiectors <br /> <br />The City of Thornton is the other objector in this case. <br /> <br />IIDENVER2ICWCBIWCTRANSISECClmjsbdmemI197cv12S6s0m.doc <br />
