Application Sununarv

This is an application for a change of water rights, new junior appropriative rights of exchange, and
an augmentation plan for various diversions located on Michigan Creek and Tarryall Creek near
Jefferson. (please see the attached map). The Applicant intends to exchange up to 20 cfs up to
various reservoirs on Tarryall Creek and Michigan Creek. In addition, the Applicant intends change
several irrigation water rights to divert thern at different points for a variety of new uses within Park
County. In addition, the Applicant intends to augment diversions with releases. frorn several
reservoirs.

Potential for Iniurv

The Applicant's proposed changes and exchanges may injure the CWCB's instream flow water
rights unless the Applicant includes terms and conditions to prevent expansion of these water rights.
In addition, the plan for augmentation may not adequately replace depletions in time, place, and
amount.
