a. Request to obtain authorization to expend funds from the Litigation Fund to defend and Protect
Colorado's allocation of water from the Colorado River.
Action: A motion was made by Eric Wilkinson with a second by Don Schwindt to approve staff
recommendation as follows:
1) authorize the expenditure of moneys, not to exceed $250,000 for the costs
associated with the preparation for possible litigation and the defense and
protection of Colorado's allocation of water in the Colorado River, and
2) direct the CWCB Director and Staff to expend these funds in coordination with
the Office ofthe Attorney General; and
3) direct the CWCB Director, CWCB staff, and Office of the Attorney General to .
comply with the annual reporting requirements as specifically provided for in
Section 37-60-121 (2.5).
Motion was approved 10-0.

b. Agenda Item #28 - Request to expend funds from the Litigation Fund for South Platte River
Cooperative Agreement
Action: A motion was made by Eric Wilkinson with a second by Barbara Biggs to authorize the
expenditure from the litigation fund in the amount of $40,000 for the purposes generally
outlined in the letter dated November 16, 2004 subject to the condition that the contract
with Steve Sims and any related ethical or contract issues are resolved to the satisfaction
of all parties. Motion was approved 10-0.
