<br />. <br /> <br />Colorado Water Conservation Board <br /> <br />Concerning the Recommendation for Instream Flow <br />Water Rights on Specie Creek <br /> <br /> <br />. <br /> <br />Case No. 02ISF03 <br /> <br />In Gunnison County <br /> <br />UNOPPOSED MOTION TO EXTEND PREHEARING STATEMENT DEADLINES <br />AND PREHEARING CONFERENCES <br /> <br />The Colorado Water Conservation Board Staff ("CWCB Staff') hereby moves the Hearing <br />Officer to extend the prehearing statement deadlines and prehearing conferences in these matters <br />pending the Colorado Water Conservation Board's consideration of requests by Staff, the Parties <br />and the Participants to vacate the hearings in these matters and to delay final action regarding the <br />CWCB's appropriations of an instream flow right on Specie Creek. Staff states the following in <br />support of this-motion: <br /> <br />. <br /> <br />1. The CWCB Staff recommended the Board appropriate an instream flow on Specie <br />Creek. The Board moved forward on these suggestions at the Board meeting in January, 2002. <br />The Wolf Land Company, John & Victoria Irwin, Jon & Joanne Corzine and Trout Unlimited <br />protested the Specie Creek appropriation. Since that time, the CWCB staffhas been in <br />negotiations with all ofthe above referenced parties. <br /> <br />2. Based upon these negotiations, the parties feel they are close to a stipulation, which <br />would resolve concerns of the objectors. <br /> <br />3. Staff has conferred with all Parties to and Participants in these proceedings and all <br />have consented to the postponement of the prehearing statement deadlines and prehearing <br />conferences until July 31. If the parties fail to file stipulations resolving the issues in this case on <br />or before July 3 I, 2002, the Hearing Officer will schedule the prehearing conference and set new <br />prehearing and rebuttal statement deadlines in these matters pursuant to the Colorado Instream <br />Flow and Natural Lake Level Program Rules and Regulations, 2 C.C.R. ,~408-2. Parties <br />understand that upon this occurrence, the hearing schedule will be accelerated in order to return <br />to the schedule dictated by the CWCB's Rules and Regulations, 2 C.C.R. ~ 408-2. <br /> <br />4. Counsel for all objectors have been consulted regarding this motion. Undersigned <br />counsel is authorized to state that all parties concur in this request. <br /> <br />. <br /> <br />
