Evans <br /> <br />Dear Gentlemen: <br /> <br />We apologize for the lateness of this response, but ask that you consider the <br />following comments regarding the proposed changes to Rules 4.40, 5.00 and 12.00 et seq. <br /> <br />We are extremely concerned that the CWCB is creating a parallel water court in <br />contravention of the existing water court structure established by the legislature. The <br />legislature established a seven-division system so that water users could protect their rights <br />without the undue burden of traveling to a centralized state water court. <br /> <br />Under the proposed rules, meaningful participation in the instream flow <br />adjudication process will be pushed further beyond the reach of many water users. In the <br />wake of Senate Bill 64, the procedures called for place an extremely expensive burden on <br />water users; requiring them to participate in such a cumbersome administrative proceeding <br />is unfair. <br />
