Evans

Dear Gentlemen:

We apologize for the lateness of this response, but ask that you consider the
following comments regarding the proposed changes to Rules 4.40, 5.00 and 12.00 et seq.

We are extremely concerned that the CWCB is creating a parallel water court in
contravention of the existing water court structure established by the legislature. The
legislature established a seven-division system so that water users could protect their rights
without the undue burden of traveling to a centralized state water court.

Under the proposed rules, meaningful participation in the instream flow
adjudication process will be pushed further beyond the reach of many water users. In the
wake of Senate Bill 64, the procedures called for place an extremely expensive burden on
water users; requiring them to participate in such a cumbersome administrative proceeding
is unfair.
