CWCB and AGO staff have solicited and received comments from members of the
Board and from other interested persons. Staff also held an informal meeting on July 8, 1999, to
answer questions and solicit comments from the water community as well as environmental and
state and federal organizations.

Staff changed some of the proposed Rules based on comments received both at the July 8
meeting and by mail. The most significant change is to the timing of the procedure to contest a
proposed instream flow appropriation. Originally, the proposed changes set forth a two step
process, the second step dealt with contested proposed appropriations. As per public comment,
the two step process has been discarded. The instream flow appropriation procedure has been
changed to the following: All instream flows to be appropriated are noticed in the January agenda
and Water Court Resume. Any interested person who wishes to contest an appropriation must
give notice by March 31, similar to the Statement of Opposition process. All hearings on
contested instream flow appropriations would occur after the September Board meeting. This

Flood Control and Floodplain Management ,Larry Lang, Chief.
