2. The name of the natural stream is:

Spring Creek (instream flow).

3. The source of the water is:

Spring Creek, tributary to East Muddy Creek, tributary to the North Fork of
the Gunnison River.

4. Legal description ofthe stream segment through which an instream flow is
claimed.

The CWCB is claiming two separate water rights. The first water right is for
natural springs and seeps in the drainage area on public lands in the
SE1I4NE1I4 Section 10, Township 12 South, Range 89 West ofthe 6th
Principal Meridian in the Gunnison National Forest at a point described as
533 feet from the East section line and 2214 feet from the North section line,
Latitude 39001' 54.3" North and Longitude 107018' 53.9" West downstream
approximately 100 feet to a point described as 770 feet from the East section
line and 2021 feet from the North section line, Latitude 390 01' 56.2" North
and Longitude 1070 18' 56.9" West.

The second water right is on public lands in the SE1I4NE1I4 Section 10, .
Township 12 South, Range 89 West of the 6th Principal Meridian in the
Gunnison National Forest, in the natural channel at a point described as 770
feet from the East section line and 2021 feet from the North section line,
Latitude 390 01' 56.2" North and Longitude 1070 18' 56.9" West down to the
headgate of the Downing Ditch, in the natural channel at a point described as
533 feet from the East section line and 2042 feet from the North section line,
Latitude 390 01' 56.0" North and Longitude 1070 18' 53.9' West.

5. Use of water:

To preserve the water dependent natural environment of Spring Creek to a
reasonable degree.

6. Date of initiation of appropriation:

May 25,2005 for the first water right, and January 23,2002 for the second
water right.

The water for the first water right was applied to the above beneficial use on
May 25,2005, by action of the Colorado Water Conservation Board under the
provision ofC.R.S. S S 37-92-102(3),37-92-103(3), (4), (10). The water for
the second water right was applied to the above beneficial use on January 23,
2002, by action of the Colorado Water Conservation Board under the
provision ofC.R.S. S S 37-92-102(3),37-92-103(3), (4), (10).
