Porzak (#2793) <br />p, Pritz Holleman (#21888) Water Division No.6 <br />929 Pearl Street, Suite 300 <br />Boulder, Colorado 80302 <br />Phone: (303) 443-6800 <br />Fax: (303) 443-6864 <br />E-mail: pfholleman@pbbJaw.com <br />STIPULATION AND SETTLEMENT AGREEMENT <br /> <br />Applicant in the above-captioned matter, Three Forks Ranch Corporation (the "Ranch"), <br />and Opposer, the Colorado Water Conservation Board (the "CWCB"), hereby stipulate and agree <br />as 'follows: <br /> <br />. <br /> <br />I. <br /> <br />The Ranch has constructed a series of ponds and restored to a natural condition <br />over 14 miles of the main stem and the Middle, North, and South Forks of the <br />Little Snake River. . <br /> <br />2. The Upper Meadow Ponds Ditch diverts water from the Middle Fork and conveys <br />it through a series of small fishery ponds called the Upper Meadow Ponds. These <br />ponds are similar to natural beaver ponds. The ponds are typically 4-7 feet in <br />depth and were designed specifically to improve the cold water fishery by <br />providing additional depth and winter holding capacity for fish. Water from the <br />Middle Fork flows into the ponds via the ditch and back into the main stem of the <br />Little Snake. <br /> <br />3. The point of diversion of the Upper Meadow Ponds Ditch is on the Middle Fork <br />of the Little Snake River approximately 850 feet upstream of the confluence with <br />the North Fork of the Little Snake River. This 850 reach of the Middle Fork is <br />hereafter referred to as the "Subject Reach." With the exception of a small <br />amount of additional evaporation loss, the diversion is essentially non- <br />consumptive, with nearly all of the diverted water returning to the stream at a <br />point about 1,900 feet (0.35 mile) downstream from the point of diversion, or <br />approximately 1,050 feet below the confluence with the North Fork of the Little <br />Snake River. <br /> <br />4. <br /> <br />Within the Subject Reach, the Ranch has installed seven rock structures (two <br />cross-vanes and five "J-Hook" vanes), together with randomly placed rock, all of <br />which were specifically designed to create fish habitat.
