<br /> <br />'J a <br /> <br /> <br />reservoir matter in Western ColoradQ J and that the Board meet on Deoember 13, 1940, <br />to further consider the small reservoir matter and proposed underground water <br />investigation. <br /> <br />Motion was duly passed, adopted and approved. <br /> <br />1940. <br /> <br />Meeting adjourned at l2:l0 o(clock to reconvene at 1:30 p.m. on November 8, <br /> <br />'Meeting reoonvened Friday, November 8, 1940, at 2:10 p.m. <br /> <br />The Board proceeded to hear representatives of federal_agencies and others <br />who had matters to present to the Board. The persons who appoared and the matters <br />discussed by them were as follows: <br /> <br />S. A. Kerr, Bureau of Reclamation discussed the status of the Paonia project <br />in Delta County, Colorado. <br /> <br />Frank C. Merriell, Seeretary-Engineer of the Colorado River Conservation <br />District, made a statement respeeting the proposed Fourirl.le Creek projeot for irri- <br />gation of pasture lands and stabilization of stream flow in Garfield County, Colorado. <br /> <br />Malcolm Lindsey, Attorney for the City of Denver and Attorney in a lawsuit <br />involving the Costilla River, explained interstate problems involved in the litigation <br />and asked for the assistanee of the Board in an attempt to adjust such oontroversy. <br />After Mr. Lindsey'S presentation it was explained that an opportunity would be affords <br />to confer with the GovernOr and State Engineer of New Meideo at the inaeting at Boulder <br />City the latter part of November and that an' attempt would be made by the Governor <br />and the Director of the Colorado Board to determine the attitude of New MexicQ with <br />respect to an attempted adjustment. <br /> <br />Jean S. Breitenstein, Attorney for the Conejos Water Users Associatiell, <br />appeared and explained that a conservanoy distriot had been set up in the Conejos <br />area to enable the oonstruction of certain featureS of the proposed San Luis Valley <br />project and to lay a basis for the execution of required repayment oontracts. lie <br />asked for the continued assistance of the Board on this project development and ex- <br />pressed appreciation of the water users of the Conejos area for the action which the <br />Board had heretofore taken in support of the San Luis Valley project. <br /> <br />Mr. Glen Jackson of the Conejos area further expressed the appreciation of <br />the Conejos area for the work which had been done to advance the construction of the <br />San Luis Valley project and expressed the desire of the area that the program go <br />ahead without interruption. <br /> <br />Thereupon Direotor Stone presented the claim of Jean S. Breitenstein in <br />the amount of $2,000 for services as special counsel for the State of Colorado in <br />the caSe of Wyoming vs. Colorado. <br /> <br />.; <br /> <br />'/ <br /> <br />After discussion it was lOOved by Mr. Hinderliderandseoonded by Mr. Dille <br />that the claim of Jean S. Breitenstein in the SUlll of $2,000 for servioes in the <br />case of Wyoming vs. Colorado be approved for payment subject to the approval of the <br />Attorney General. <br /> <br />Motion was duly passed and approved, Governor Ralph L. Carr not parti- <br />cipating in the vote. <br />
