11

.

Consent Agenda Item 2h
Case No. 5-00CW252; Town of Basalt

Aoolication Sununwy

This is an application for an augmentation plan and change of diversion point near the Town of
Basalt (see attached map). The Applicant seeks a new point of diversion from a well, upstream of
the confluence of the Roaring Fork River and the Fryingpan River. The Applicant also proposes an
augmentation plan that would use Ruedi Reservoir as a source of augmentation.

CWCB Ao.prooriations

The Board holds an instream flow water right for the Roaring Fork River in the amount of 55 cfs
(4/1-9/30) and 30 cfs (1011-3131) with an appropriation date of Il/8/85, which may be injured by
this application.

Potential for Iniurv

This application may not replace the depletions in time place and amount and thus may cause injury
to the Board's Roaring FoIt River instream flow. In addition, the Applicant's diversion of water at
an upstream point of diversion may cause injury to the Board's Roaring Fork River instream flow.

.

Other Obiectors

The other objectors in this case are: Josephine Arbaney; the Pitkin County BOCC; the Grange
Family Ranches, LLC; the Roaring Fork School Dis\rict; the Twin Lakes Reservoir and Canal Co.;
the Buttennilk Metropolitan District; and the Roaring Fork Club, LLC.

.

\\DENVBR2ICWCBIWCTRANSISECClCase Filesl20001S0OCW2S2.meJll,doc
