<br />. <br /> <br />. <br /> <br />. <br /> <br />The injury to the above-described CWCB water rights could <br />occur along Boulder Creek in the segment from the confluence of <br />Boulder and Fourmile Canyon Creeks. This segment is approximately <br />two miles in length. The injury would occur because the <br />augmentation water is not available to Boulder Creek until it <br />reaches the Lower Boulder Ditch headgate some two miles below 75th <br />Street. The extent of the injury will be about 5 acre-feet per <br />year in this two mile segment, the lower terminus of which is at <br />75th Street. <br /> <br />Other Statements of Opposition were filed in this case by the <br />Public Service Company of Colorado, Water Users Association, City <br />of Boulder, and Farmer's Reservoir & Irrigation. <br /> <br />Staff Recommendation: <br /> <br />The staff recognizes that this is a very small degree of <br />injury. However, since the Board holds a very senior water right <br />which was purchased with funds from the Division of Wildlife for <br />the purpose of preserving the natural environment to a reasonable <br />degree, the staff recommends that the Board ratify the Statement <br />of Opposition already filed by the staff and direct the staff to <br />work with the applicant to resolve the Board's concerns. <br /> <br />/bvm <br /> <br />MEMORANDUM <br /> <br />-2- <br /> <br />January 4, 1985 <br />
