.

.

.

The injury to the above-described CWCB water rights could
occur along Boulder Creek in the segment from the confluence of
Boulder and Fourmile Canyon Creeks. This segment is approximately
two miles in length. The injury would occur because the
augmentation water is not available to Boulder Creek until it
reaches the Lower Boulder Ditch headgate some two miles below 75th
Street. The extent of the injury will be about 5 acre-feet per
year in this two mile segment, the lower terminus of which is at
75th Street.

Other Statements of Opposition were filed in this case by the
Public Service Company of Colorado, Water Users Association, City
of Boulder, and Farmer's Reservoir & Irrigation.

Staff Recommendation:

The staff recognizes that this is a very small degree of
injury. However, since the Board holds a very senior water right
which was purchased with funds from the Division of Wildlife for
the purpose of preserving the natural environment to a reasonable
degree, the staff recommends that the Board ratify the Statement
of Opposition already filed by the staff and direct the staff to
work with the applicant to resolve the Board's concerns.

/bvm

MEMORANDUM

-2-

January 4, 1985
