DISCRIMINATION AGAINST EMPLOYEES O~ APPLICATION FOR EMPLO~1ENT <br />PROHIBITED <br /> <br />I~ connection with the perfor~ance of ~ork under this contract, CORY agrees <br />not to discri~nate against any employee or applicant for e~ploy~ent <br />because of sex. race, religion, color, O~ national origin. The aforesaid <br />provision shall include but not be li~ted to, the follo~ing: employment, <br />upgrading, demotion, or transfer, recruitment, or recruitment adve~tising; <br />layoff or termination, rates of payor other forms of compensation; and <br />selection for training, including apprenticeship. 'CORY agrees to post' <br />hereafter in conspicuous places, available for employees and applicants for <br />ecployrnent, notices to be provided by the contracting office setting forth, <br />the provisions of the nondiscrimination clause. CORY further agrees to <br />insert the foregoing provision in all subcontracts hereunder, except sub- <br />contracts for standard cOmQercial supplies or raw materials. <br /> <br />7. OFFICIALS NOT TO BENEFIT <br /> <br />No me~ber or delegate to Congress or Resident Commissioner shall be <br />ad~tted to any share or part of this contract or to any benefit that may <br />arise therefrom, but this restriction shall not be construed to extend to <br />this contract if made with a corporation or company for its general <br />benefit. <br /> <br />8. COVEN~~T AGAINST CONTINGE~~ FEES <br /> <br />6 <br /> <br />. <br /> <br />(a) The Contractor warrants that no person or agency has been employed .' <br />or retained to solicit or obtain this contract upon an agreement or <br />understanding for a continp;ent fee, except a bona fide employee or agency. <br />For breach or violation of this warranty, the Government shall have the <br />right to annul this contract without liability or, in its discretion, to <br />deduct from the contract price or consideration, or othe~ise recover, the <br />full amount of the contingent fee. <br /> <br />(b) ~Bona fide agency," as used in this clause, means an established <br />commercial or selling agency, maintained by a contractor for the purpose of <br />securing business, that neither exerts nor proposes to exert improper <br />influence to solicit or obtain Government contracts n?r holds itself out as <br />,being able to obtain any Government contract or contracts through improper <br />inf luence. <br /> <br />"Bona fide employee,. as used in this clause, means a person, employed by a <br />contractor and subject to the contractor's supervision and control as to <br />ttoe, place, and manner of performance. ~ho neither exerts nor proposes to <br />exert improper influence to solicit or obtain Government contracts nor <br />holds out as being able to obtain any Government contract or contracts <br />through improper influence. <br /> <br />"Contingent fee," a.s used in this clause. means any cocw1ssion, percentage, <br />brokerage, or other fee that is contingent upon the success thut a person <br />or concern has 1n securing a Government contract. <br /> <br />. <br />
