<br />the the Henry Waneka Reservoir Company for non-payment of Board <br />funds be discussed in executive session after the meeting on ~ <br />January 14. 1985. and over breakfast on January 15. 1985. the <br />second day of the meeting. <br /> <br />Ms. Weiss agreed that these items are appropriate for <br />discussion in executive session. <br /> <br />Mr. Smith moved. seconded by Mr. Getches. that the above <br />items be considered during executive session. Motion approved <br />unanimously. <br /> <br />Chairman Johnston recessed the January 14 meeting at 4:15 <br />p.m. for the executive session. <br /> <br />Chairman Johnston reconvened the meeting at 9:50 a.m. on <br />January 15. 1985. <br /> <br />Mr. McDonald reported on Board actions taken during the <br />executive session as follows: <br /> <br />a. Arkansas River Compact Issues <br /> <br />Mr. Johnston moved. seconded by Mr. Furneaux. that the <br />Board transmit a resolution to the General Assembly and <br />the Governor. concerning the possible litigation with <br />the State of Kansas over the operation of Trinidad and ~ <br />Pueblo Reservoirs. Motion 'adopted unanimously. .., <br /> <br />. .~ <br /> <br />Mr. Vandemoer moved. seconded by Mr. Covert. that <br />copies of the Board's resolution be sent to the <br />Southeastern Colorado and Purgatorie Water Conservancy <br />Districts. major ditch companies in the Arkansas River <br />Basin. and the City of Trinidad. Motion adopted <br />unanimously. <br /> <br />b. Liability of Board Arisinq from Floodplain Desiqnations <br /> <br />No Board action taken. <br /> <br />c. Henry Waneka Reservoir Company Litiqation <br /> <br />Mr. Robbins moved. seconded by Mr. Lochhead. that the <br />Attorney General. with concurrence from the Board staff. be <br />authorized to settle this case for any sum over $5.000. Motion <br />adopted unanimously. <br /> <br />Aqenda Item 19 - Criteria for Desiqnation and Approval of <br />Floodplains - Appendix K <br /> <br />In the discussion of this topic.
