<br />Agenda Item 28 <br />May 16-17, 2006 Board Meeting <br />Page 4 of4 <br /> <br />Pursuant to Article XIV of the Upper Colorado River Basin Compact the State of Colorado agreed . <br />to deliver from the San Juan River and its tributaries sufficient water, together with waters from . <br />the same arising in New Mexico, to enable the State of New Mexico to make full use of its <br />compact apportionment. Therefore, New Mexico's gains in the HD come at some expense to <br />Colorado's water users. While the expense to Colorado's users maybe relatively small, those <br />gains in conjunction with endangered fish flow recommendations and the recent drought <br />conditions have shown them to be problematic. New Mexico and Colorado have generally had a <br />very good working relationship as witnessed by getting the Animas-La Plata project to <br />construction and the San Juan River Endangered Fish Recovery Program implemented. Never- <br />the-less as the competition for the water resource increases that cooperation becomes stressed as <br />witnessed by events surrounding the proposed Long Hollow Reservoir Project. As a result, <br />Colorado water users in the San Juan basin would like some assurance that there is some equity in <br />meeting their future water needs as well. We expect representatives of Colorado's San Juan River <br />Basin water users to speak to this matter at the Board meeting and Board staff, to the extent such <br />assurances are reasonably possible, would support their requests. <br /> <br />With respect to the calculation of consumptive uses and the development of future depletion <br />schedules, New Mexico has agreed to calculate its consumptive uses in the same manner as the <br />other three Upper Basin States using the Modified Blaney-Criddle method. While we still have <br />some outstanding issues with other consumptive use considerations (ephemeral streams, point of <br />impact) those considerations are not critical to the proposed HD and can be worked out at a later <br />time. <br /> <br />The Upper Colorado River Commission will be asked to consider a resolution in support of this . <br />HD at its June 5th Commission meeting. Attached is a draft of the proposed resolution the <br />Commission will consider. While there is still some work on the resolution to be accomplished <br />and we would still want to see the Settlement subordination language included, we never-the-Iess <br />would like the Boards concurrence in the concepts and direction of the revised HD. <br /> <br />Recommendation <br /> <br />Staff recommends that Board concur in concept with the proposed Hydrologic Determination as <br />illustrated on the attached model run spreadsheet and support Colorado's Upper Colorado River <br />Compact Commissioner in the affirmative on the attached resolution so long as such remains <br />consistent with the concepts advanced therein. <br /> <br />Staff further recommends that the Board direct staff to work with Colorado's San Juan River Basin <br />water interests to achieve, to the extent reasonably possible, the assurances and equitable future <br />water development opportunities desired. <br /> <br />Attachments: <br />Model Run 18 spreadsheet <br />Draft UCRC Resolution <br />Letter from Southwestern Water Conservation District <br /> <br />.J <br /> <br />Flood Protection.
