<br />. <br /> <br />. <br /> <br />. <br /> <br />::it) y <br /> <br />MOTION BY CWCB <br /> <br />1be board concurs with the proposed Hydrological Determination as illustrated in the <br />material provided by staff and supports a vote in the affirmative for the attached <br />resolution by Colorado's commissioner to the Upper Colorado River Commission, as <br />long as any changes to the resolution remain consistent with the concepts presented by <br />staff and as suggested below by Southwestern Water Conservation District. <br /> <br />The Board directs staff to work with Colorado's San Juan River basin water interests to <br />achieve, to the extent reasonably possible, the assurances and equitable future water <br />development opportunities desired, including but not limited to, the requests made by the <br />Southwestern Water Conservation District in its May 9, 2006, letter. <br /> <br />SOUTHWESTERN WATER CONSERVATION DISTRICT'S PROPOSED CHANGES <br />to draft UCRC resolution: <br /> <br />Additional Recital: <br /> <br />'WHEREAS, depletions anticipated under this resolution will all be diverted from the San <br />Juan River basin and such depletions are considered by the USFWS in Section 7 <br />Consultations and reported in sufficient progress findings under the San Juan River Basin <br />Recovery Implementation Program ("SJRIP") and is one component considered in <br />developing flow recommendations necessary to recover the endangered fish; therefore, <br />additional depletions allowed New Mexico under this Resolution will deplete additional <br />water under the existing or modified SJRIP flow recommendations which have been <br />used, but absolutely should not be used, to constrain the opportunity for water users in the <br />Colorado portion of the San Juan River Basin to deplete additional water under the <br />Colorado River Compact. . <br /> <br />Between the last and next to last resolution paragraph add: <br /> <br />BE IT FURTHER RESOLVED, the Commission supports the hydrologic determination <br />as set forth in the first resolution paragraph above as long as Colorado's ability under its <br />Upper Colorado River Compact allocation to use and deplete water in the San Juan River <br />basin, including development allowed under SJRIP, is not impaired either by New <br />Mexico or otherwise. <br /> <br />BE IT FURTHER RESOLVED, that the Commission supports provisions in any Federal <br />legislation to protect Colorado water users in the San Juan River basin in accordance with <br />the above. <br />
