<br />Adjourn: 5:39 p.m. <br /> <br />Tuesday, July 24, 2001 <br /> <br />Call to Order <br /> <br />8:06 a.m. <br />A regular meeting of the Colorado Water Conservation Board was <br />reconvened at The Montrose Pavilion, 1800 Pavilion Drive, Montrose, <br />Colorado, 81402 at 8:06 a.m. on Tuesday, July 24, 2001. The meeting <br />was called to order by Chairman Harold Miske!. Eight voting members <br />were present at the call to order so a quorum was present (at least six <br />required). Board members present on this date were Greg Hoskin, Greg <br />Walcher, Bob BUff, Lewis Entz, Harold Miskel, Donald Schwindt, David <br />Smith, Keith Catlin, Eric Wilkinson, Bruce McCloskey (representing the <br />Division of Wildlife) Felicity Hannay (representing the Attorney General <br />Ken Salazar and counsel to the Board, with other AG staff Linda Bassi, <br />Wendy Weiss, and Susan Schneider present), Commissioner of <br />Agriculture Don Ament, State Engineer Hal Simpson and Rod Kuharich. <br /> <br />16. Stream and Lake Protection - New Appropriations - Yampa River <br />Tape 2, Start/Stop: 4885 - 5775 <br />Action: A motion was made by David Smith that as the Board had gone through <br />the findings and found them to be proper, that the Board accept the staff <br />recommendation as listed in the Board memo. The motion was seconded <br />by Bob Burr and approved (8-0). A second motion was made by Don <br />Schwindt that the Board vacate the September 2001 hearing on these <br />appropriations. The motion was seconded by Eric Wilkinson and <br />approved (8-0). <br /> <br />17. Stream and Lake Protection - New Recommendations in Water Division 4 <br />Tape 2 Start/Stop: 5775 - 7179 <br />Tape 3 Start/Stop: 0001 - 1146 <br />Action: Information item; no action taken. <br /> <br />18. Stream and Lake Protection - Reconsider ation of Ratification of Statement of <br />Opposition, Request to Enter into Stipulation and Withdr aw Statement of <br />Opposition - Three Forks Ranch <br />Tape 3, Start/Stop: 1146 - 3040 <br />Action: A motion was made by Eric Wilkinson to re-ratify the Statement of <br />Opposition filed by the CWCB staff in Case No. 6-00CW 48. The motion <br />was seconded Greg Walcher and approved (9-0). A second motion was <br />made by Don Schwindt that the Board initiate the 2 meeting process <br />required to accept injury with mitigation (of which this meeting will be the <br />first) and pursue this stipulation with the changes suggested by Greg <br />Hoskin, and the suggestion by Hal Simpson that language requiring a gage <br />and measuring device be provided in the stipulation.
