Walcher <br />Executive Director <br /> <br />Rod Kuharich <br />CWCB Director <br /> <br />Pan McAuliffe <br />Deputy Director <br /> <br />By letter dated June 14,2002 (attached), the Board of Directors of the Colorado Water and <br />Power Development Authority (the Authority) has requested that the Colorado Water Conservation <br />Board (CWCB) review the Memorandum of Understanding (MOV) between the Authority and the <br />CWCB. The purpose of the review is to determine if the CWCB agrees with the Authority that the <br />MOU should be tenninated. <br /> <br />Background <br /> <br />In 1990, the Authority and the CWCB entered into an MOU to aid and expedite the <br />perfonnance of the statutory duties of the CWCB and the Authority, The MOU was superceded by <br />an updated version on December 5,1997 (attached). Paragraph 2 of the MOD states that it shall <br />"govern the activities of the CWCB and the Authority according to its terms, unless" .otherwise <br />directed by the Colorado General Assembly, by bill" ,signed by the Governor." <br /> <br />The Authority's main reason to tenninate the MOD lies with paragraph 4,D, of the MOD that <br />states that the Board require that loan applicants must make a "thorough exploration of all other <br /> <br />Flood Protection.
