The Board shall determine the <br />appropriateness of any acquisition of water, water rights, or interests in water to <br />preserve or improve the natural environment. Such determination may include, <br />but may not be limited to consideration, of the following factors: <br />. the length of the stream reach, <br />. the natural flow regime, <br />. any potential material injury to existing decreed water rights, <br />. and/or the cost of the transaction. <br /> <br />The Board shall also determine how be~t to utilize the acquired water, water <br />rights or interest in water to preserve or improve the natural environment. <br /> <br />f. Limitation on ACQuisitions. The Board, may not accept a donation of water <br />rights that would require the removal !If existing infrastructure without <br />approval of the current owner of such Infrastructure, or a donation of water <br />rights that were acquired by condemllldion. <br /> <br />g. Temporarv ACQuisitions, The Board hereby delegates authority to the CWCB <br />.Director to accept temporary acquisitions of water, water rights, or interests in <br />water for a current calendar year to preserve or improve the natural <br />environment, and to take whatever administrative actions are necessary to put <br />the acquired water to nse. The CWC~ .Director's authority under this rnle is <br />subject to the following limitations: <br /> <br />(1) The CWCB .Director must ()btain the approval of the State Engineer <br />to use the donated water under the ISF Program. <br /> <br />(2) The CWCB .Director shall advise the Board in a timely manner of all <br />temporary acquisitions accepted pursuant to the authority granted <br />herein. <br /> <br />h, Funds for Water Rieht ACQuisitions.
