Walker <br />Deputy Director <br /> <br />TO: <br /> <br />Members, CWCB <br /> <br />DATE: September 13, 1988 <br /> <br />SUBJECT: Agenda Item 14b, September 22-23, 1988, Board Meeting-- <br />Stipulations Concerning Instream Flow Water Rights <br />Case No. 1-85CW421; North Fork Lone Pine Creek <br />Case No. 1-85CW424; South Fork Lone pine Creek <br />Case N9. 1-85CW433; Lone pine Creek <br />Case No. 1-85CW426; Panhandle Creek <br /> <br />Case Summary <br /> <br />. <br /> <br />At its November, 1985, meeting, the Board approved final <br />instream flow recommendations for North Fork Lone Pine, South <br />Fork Lone Pine, Panhandle, and Lone pine Creeks, tributaries to <br />the North Fork Cache la Poudre River in Larimer County. <br />Crystal Lakes Water and Sewer Association (Crystal) and Red <br />Feather Storage and Irrigation Company (Red Feather) <br />subsequently filed Statements of Opposition. <br /> <br />Proposed Stipulations with Crystal <br /> <br />Crystal opposed Case Nos. 1-85CW421 and 426 because of its <br />interest in several onstream lakes in the area. As a result of <br />negotiations, the attorney for Cyrstal has signed proposed <br />stipulations in which the Board recognizes the existence of the <br />affected ponds and lake. In Case No. 1-85CW421, the <br />stipulation recognizes that the Board's instream flow is junior <br />to an existing decree: <br /> <br />Objector, Crystal, is the owner of a water right in and to <br />Lower Lone Pine Lake, a reservoir, which is located on the <br />North Fork of Lone pine Creek (W-92B8). The Board seeks <br />to establish an instream flow water right which intersects <br />the high water line of Lower Lone Pine Lake. <br /> <br />The Board recognizes that the beneficial use of the waters <br />of Lower Lone Pine Lake, and the operation of that <br />reservoir may cause inundation of some portion of the <br />stream segment included within the Board's application in <br /> <br />. <br /> <br />7998E <br />
