These regulations shall ~ot create <br />liability on the part of (local qovernment) ,the State of <br />Colorado and the Federal Emergency Management Agency or <br />any officer or employee thereof for any flood damages <br />that result from reliance on these regulations or any <br />ad~inistrative decision lawfully made thereunder. <br /> <br />Severability - If any section, clause, provision, or <br />portion of these regulations should be found to be <br />unconstitutional or otherwise invalid by a court of <br />competent jurisdiction, the remainder of this regulation <br />shall not be affected thereby and is hereby declared to be <br />necessary for the public health, safety, and welfare. <br /> <br />Amendments - The requirements. restrictions, and <br />boundaries set forth in these regulations may from time to <br />time be amended, supplemented, changed, or repealed in <br />accordance with the procedures set forth below. <br /> <br />Amendments to the requirements or restrictions of these <br />regulations or to the boundaries on the Official maps and <br />any adopted reports or supporting materials shall be <br />officially made by the (Board of County Corr~issioners, <br />City council, Board of Trustees) only after all of the <br />procedures required for adoption of the official maps, as <br />enumerated in Section 2.3.2.2 of these regulations, have <br />been followed. <br /> <br />Maintaininq Floodplain Manaqement Proqram Documents for <br />Public Inspection <br /> <br />(Local qovernment) is to maintain for public inspection <br />copies of the community's Floodplain Management Ordinance, <br />Flood Insurance Study and Maps, Letters of Map Amendment, <br />and all records pertaining to floodplain developments. <br />These records include certified lowest floor elevations, <br />flood proofed elevations, certificates of floodproofing <br />methods and floodway encroachment, and records of variance <br />actions. (Local qovernment) shall not be required to <br />provide lowest flood and floodproofing elevations to <br />insurance agents but they shall make the maps and reports <br />necessary for such a determination available upon request <br />so that National Flood Insurance Policies can be rated <br />correctly. It shall not be the responsibility of local <br />government to determine for lending institutions whether <br />or not a property is located in a Flood Hazard Area or to <br />determine the Flood Insurance Rate lone of a property for <br />insurance agents. <br /> <br />-31- <br />
