<br />~ t:f <br /> <br />- 3- <br /> <br />. <br /> <br />Iniurv with Mitigation Proposal <br />The District submitted a written injury with mitigation proposal to staff in July 2005, which the <br />Board reviewed at its September 2005 meeting. After further discussion with Staff and the <br />Division of Water Resources, on June 23, 2006, the District submitted an updated proposal that <br />addresses each application separately. The proposal is summarized below and is attached to this <br />memo. <br /> <br />1. Case No. OlCW305 Plan <br /> <br />. This plan is limited to water users wi1hin the Critical Reach who obtained a water <br />allotment contract with the BWCDS on or before December 31, 2004, including (I) <br />contractees who were involved in previous decreed plans for augmentation and (2) <br />twenty new water contracts identified in Case No. 01 CW30S. <br />. Assuming 100% occupancy, diversions will average O.llcfs, ranging from 0.03 cfs in the <br />winter to 0.26 cfs in midsummer. Average monthly consump1ion ranges from an average <br />of O.OOS cfs (winter) to 0.18 cfs (midsummer). <br />. This plan would allow covered water users to continue to divert and use wa1er indoors <br />during an ISF call. <br /> <br />. <br /> <br />Proposed Mitigation <br /> <br />. The District will fund 2S% of the costs of installing a continuous reading stream gage in <br />the critical reach of the Roaring Fork River, up to $S,OOO, and will contribute $S,500 <br />annually 10 on-going operation and maintenance costs associated wi1h the gage for a <br />minimum of five years. Further, the District will negotiate with other local water users to <br />form a group of cooperators to pay for the remaining 0 & M costs. <br /> <br />. If (during April through September) flows in the Critical Reach drop to 62 cfs (7 cfs <br />above the decreed ISF amount), the District will <br />o coordinate with the Division Engineer to ensure that all junior diversions affecting <br />the Critical Reach are curtailed, and <br />o direct all Distric1 contractees located in the upper Roaring Fork basin to <br />implement water conservation measures as described in the Dis1rict's water <br />conservation handbook, which the District will prepare and dis1ribute as part of <br />the offered mitigation. This directive will be given to all District contractees in <br />the Critical Reach, not just those associated with Case No. 01 CW305. <br />. If flows in the Critical Reach drop to 58 cfs (3 cfs above the decreed ISF amount), the <br />District will direct all of its contractees in the upper Roaring Fork basin to curtail all <br />outdoor lawn, garden, and open space irrigation and aesthetic/piscatorial pond filling. <br />This directive will be given to all District contractees in the Critical Reach, not just those <br />associated with Case No. 01 CW30S. The Distric1 anticipates that implementation of this <br />measure will result in depletions in the Critical Reach dropping from an average of 0.53 <br />cfs to less than 0.2 cfs. <br />. The District will hire a seasonal hydrologic technician to adminis1er the provisions of the <br />Mitigation Plan, including field inspection of individual water users to confirm <br />compliance with the directive to curtail outdoor wa1er use. <br /> <br />. <br /> <br />Floud Protection.
