The Applicant <br />is proposing to divert water rights that are decreed on Muddy Creek at a number of upstream points <br />of diversion on the Fraser River near the Town of Fraser (see attached map). <br /> <br />CWCB Appro.vriations <br /> <br />The Board holds instream flow water rights on the Fraser River for various amounts with an <br />appropriation date of 11/27/1990. <br /> <br />Potential for Iniury <br /> <br />This application may cause injury to the Board's Fraser River instream flow water rights. At times <br />when the CWCB's instream flow water rights are not being satisfied, the Applicant must curtail <br />diversions at the proposed upstream alternate point of diversion. In addition, the Applicant must <br />not operate the claimed exchange from Wolford Mountain Reservoir up to its diversion points on <br />the Fraser River at times when the CWCB's instream flow water rights on the Fraser River are not <br />satisfied. <br /> <br />Other Objectors <br /> <br />The other objectors in this case are: the Grand County Water and Sanitation District; the Winter <br />Park Water and Sanitation District; the Town of Fraser; the Middle Park Water Conservancy <br />District; the Winter Park Recreational Association; the Colorado River Water Conservation District; <br />the Winter Park West Water and Sanitation District; the Town of Granby; the Grand Elk Partners, <br />LLC; and Solvista Inc. <br /> <br />L:\Seclion Folders\SECC\Case Files\200 1\50 I CW357 _mem.doc <br />
