<br />Agenda Item 6b <br />Case No. 1-98CW448; City of Golden <br /> <br />Application Summarv <br /> <br />This is an application for an absolute and conditional water right on two segments of Clear Creek <br />within the boundaries of the City of Golden in Jefferson County (see attached map). Applicant is <br />seeking approval of absolute water rights, ranging from 75 to 992 cfs, for 8 dams and/or flow <br />deflector devices built on a stretch of the mainstem of Clear Creek. This reach of the Creek is <br />referred to as the City of Golden White Water Course. In addition, Applicant is requesting <br />conditional water rights- (8 to 232 cfs) to increase the flow to 1000 cfs during the months of May <br />through July. Finally, Applicant is proposing to build 10 additional structures in the adjacent reach,. <br />referred to as the City of Golden White Water Course Extension, and requesting conditional water <br />rights equal to the above absolute and conditional water rights (75 to 1000 cfs). <br /> <br />CWCB Appropriations <br /> <br />The Board does not hold an instream flow right on this segment of Clear Creek. <br /> <br />Potential for Iniury <br /> <br />Applicant's request for absolute and conditional water rights for purposes similar in nature to <br />instream flow use may conflict with the provisions of Section 37-92-102 (3), C.R.S. (1990). Said <br />Section provides: "... no other person or entity [other than the Board] shall be granted a decree <br />adjudicating a right to water or interests in water for instream flows in a stream channel between <br />specific points, ..., for any purpose whatsoever." <br /> <br />Other Obiectors <br /> <br />Other objectors include the Coors Brewing Company, the City of Arvarla, the City of Georgetown, <br />the City of Westminster, the City ofIdaho Springs and the Clear Creek Skiing Corporation. <br /> <br />L:\boardmem\mllrcb 99\aenda lem 6b, city of golden <br />
