Applicant proposes new alternate uses for the
Pharo, Pharo-Bauer, and Pharo-Bauer No.1 irrigation water rights to include piscatorial,
recreation, and fish and wildlife habitat enhancement purposes. Applicant also seeks to
"adjudicate each of the ditches" ..... "as alternate and supplemental points of diversion for the
water rights decreed to each of the other ditches so that any or all of the rights can be diverted
at any of the headgates."

CWCB Appropriations

The Board holds an instream flow decree for 60 cfs, summer, and 85 cfs, winter, on the Blue
River with an appropriation date of October 2, 1987, which could be injured by this application.

Potential for Iniurv

Applicant's request to change the decreed use and the points of diversion of its senior irrigation
rights may deplete the Board's instream flow rights on the Blue River.

Other Objectors

Other objectors include the Colorado River Water Conservation District, the City and County of
Denver, and the State and Division Engineer.

a:594CW22S.mem
