BACKGROUND

The Water Conservation Act of 1991 (~~ 37-60-124 through 129, eR.S. (1997)) (the "Act") states that
the Board shall not accept an application from a covered entity (entities that supply 2,000 acre- feet of
retail water annually for domestic, commercial, and industrial use) for financial assistance in the
construction of any water diversion, storage, conveyance, water treatment, or wastewater treatment
facility unless such covered entity includes a copy of their water use efficiency plan. The Board shall
consider a covered entity's water use efficiency plan in determining whether to render financial
assistance.

OFFICE OF WATER CONSERVATION PLANNING PROGRAM

The Office of W at~r Conservation has developed an internal process to accept plans from covered entities
and to notify new entities that fall under the Act. This internal process includes criteria for acceptance
upon review of a water conservation plan (See attachment). We notify and work with any entity that does
not fulfill the Act's requirements of planning. This assistance is offered verbally, through written
correspondence or through on-site visits with the entity.

CWCB's loan application form will request information regarding the covered entity's water conservation
plan. The Board memos requesting approval ofloan applications will inform the Board of the applicant's
water use efficiency plan.

CONCLUSION

The staff feels that the current process is sufficient for the Board to exercise its duties under the Act to
consider covered entity loan applicants' water use efficiency plans when deciding whether to render
financial assistance to those applicants.
