The Applicant is proposing to store <br />water at an alternate place of storage. The Applicant's proposed change of place of storage may be an expansion of <br />use that would injure the Board's instream flow water rights on the Williams Fork River. The <br />Applicant cannot divert at the alternate place of storage under the Lost Creek Intake and Lost Creek <br />Reservoir at times when the CWCB's instream flow rights on the Williams Fork River, from the <br />confluence of Lost Creek and the Williams Fork River to the confluence of Ute Creek and the <br />Williams Fork River, are not being satisfied. The Applicant is also seeking approval of an alternate <br />place of storage for several other decreed diversion points and places of storage. No expansion of <br />use may be petmitted. Thus, the Applicant can only divert at the alternate place of storage, the <br />amount of water physically and legally available at the original points of diversion. In addition, the <br />Applicant may not exceed the contemplated draft of the original decreed diversion points and <br />reservoirs. <br /> <br />Other Obiectors <br /> <br />Other objectors in this case include the City and County of Denver and the Middle Park Water <br />Conservancy District. <br /> <br />\\DENVER2\CWCB\BOARDMEM\Sept 2000\consent agenda item t b.doc <br />
