.

.

.

Agenda Item 13h
Case No. 5-97CW272; Antones Cabin Creek

Case SummaI)'

The Board at its September 22, 1997, meeting appropriated the following instream flow water right
on Antones:

Case No.

Approp. Date

Stream

Amount

5-97CW272

Antones Cabin
Creek

September 22, 1997

2.5 (4/15-9/30)
0.5 (10/1-4/14)

The location of this stream segment through which the instream flow is claimed is from the
headwaters and extending to the confluence of West Brush Creek, being a distance of
approximately 5.2 miles.

. This application was opposed by the L.E.D.E. Limited Liability Company, which is the owner of the
L.E.D.E. Ditch and Reservoir.

Instream Flow Appropriation Adiustment as per Rule 5.60

As per Rule 5.60 of the ISF Rules and Regulations, staffis requesting the Board further segment
the Antones Cabin Creek Instream Flow reach requested in Case No. 5-97CW272, because of
valid water availability concerns raised by the objectors. CWCB and AGO staff met with
representatives of the LEDE LLC to perform a site inspection. The site inspection revealed that
Antones Cabin Creek disappears on the surface about 1/4 mile below the LEDE Ditch. Antones
Cabin Creek does not appear on the surface again until several hundred yards below the point at
which it disappears. Staff requests the following segmentation so that the instream flow
appropriation will more accurately reflect current stream conditions:

Case No. Stream

Reach

Amount

5-97CW272 Antones Cabin Creek

2.5 (4/15-9/30)
0.5 (10/1-4/14)

2.5 (4/15-9/30)
0.5 (10/1-4/14)

headwaters to the LEDE Ditch
(see attached map)

Antones Cabin Creek

unnamed trib to West Brush Ck
(see attached map)

This change in the application shall not be deemed a modification that is required to follow the
procedures in Section 10 of the Rules and Regulations.
