Final Notices (Division 5) (Appendix K) <br /> <br />Mr. Jencsok briefed the. Board and explained'the staff's <br />reasoning for its recommendations concerning the final <br />notice for Division 5. Following discussion, Mr. Johnston <br />moved, seconded by Mr. Smith, that: <br /> <br />(1) the instream flow recommendations for ,Which a , <br />preliminary notice had been made for Parachute, the <br />lower segment of Ea$t Middle Fork Parachute, the <br />lOy.'er segment of Ea$t Middle Fork Falls, and Clear <br />Creeks not be considered further, and <br /> <br />(2) the final instream flow recommendations for the <br />'upper segments of East., Middle Fork Parachute Creek" <br />Tr'a'ppers .Creek; 'and Nort.hwa't'er Creek (Appendrx K) <br />be approved. . <br /> <br />, .' <br /> <br />The motion was adopted unanimously. <br /> <br />c. Ratification of. Stipulation <br /> <br />(1) Case No. 4-83CW227 (Lotis Creek) . <br />t1r. Lochhead moved.. seconded by Mr. Johnston, that <br />the Board ratify the proposed stipulation in this case <br />.(Appendix L). The motion wa$ adopted unanimously. <br />I <br />I <br />(2) Case No. 4-84CW20.8 (Cril.~y='~and cebria~)'- <br /> <br />There was lengthy ~oard di~cussion concerning questions <br />about the proposed' stipulation (AppendiX M), .such a's wh'a 'would <br />install the gage(s)~ who should monitor the gage(s), Who would be <br />maintaining the gage(s), and how to call for administration. <br />Following this discussion, Mr.. Johnston moved that the Board <br />ratify the stipulation. This motion died for lack of a second. <br /> <br />Following further disc'ussion, 'Mr. Getches moved, seconded by <br />Mr. Smith, that the pr.oposal' stipulation be rejected and the <br />staff directed, to renegotiate it.. This motion failed with one <br />yes vote, two no votes, 'and ,aLl other Board members abstaining. <br /> <br />Mr. Robbins then moved, seconded by Mr. Getches, that the <br />matter be tabled until the Nov'ember, 1985, meeting. This motion <br />failed with one yes vote, ,three' no votes, and all other Board <br />members abstaining. <br /> <br />After more discussion, Mr. Johnston moved, seconded bY'Mr. <br />Smith, that the Board ratif~ the proposed stipulation. <br /> <br />. <br /> <br />-8- <br />
