The action taken was a result of a January 27, 2005 meeting between Keith Catlin, Rod <br />Kuharich, Ann Nichols (Authority Chair) and Dan Law (Authority Executive Director). The <br />documentation leading up to that meeting is included in the attached letters dated December 21, <br />2004, January 10, 200S, and February 3, 200S between the parties involved. The purpose of this <br />review is to determine if the CWCB agrees with the Authority that the MOD should be mutually <br />terminated. <br /> <br />Background <br /> <br />In 1990, the Authority and the CWCB entered into an MOD to aid and expedite the <br />performance of the statutory duties of the CWCB and the Authority. The MOD was superceded by <br />an updated version on December S, 1997 (attached). Paragraph 2 of the MOD states that it shall <br />"govern the activities of the CWCB and the Authority according to its terms, unless.. .otherwise <br />directed by the Colorado General Assembly, by bill.. .signed by the Governor." <br />Flood Protection.
