Applicant has determined that approximately 20% of the ground water withdrawn from its wells <br />is tributary to Beaver Creek. The Board Staff has determined that this amount will result in a <br />one-percent depletive effect or less to the Board's rights on Beaver Creek. Therefore, <br />Applicant's out-of-priority depletions that occur from the pumping of wells that affect Beaver <br />Creek fall under the De Minimis provisions of Rule 9.30 of the CWCB's Rules and Regulations <br />Concerning the Colorado Instream Flow and Natural Lake Level Program, 2 CCR 408-2. <br /> <br />. Applicant shall release water from the Silverheels Augmentation Reservoir to replace stream <br />depletions that affect Crooked Creek and the Middle Fork of the South Platte River as a result <br />of the new uses proposed in this application. <br /> <br />. Pursuant to C.R.S. Section 37-92-502(5), Applicant shall install, maintain, and monitor at <br />locations determined by the State or Division Engineer and at its own expense such measuring <br />device( s), if any, as are deemed necessary by the State or Division Engineer to administer the <br />terms of this stipulation.
